Non-profit organizations are raising millions of dollars by hosting Texas Hold 'em poker tournaments in the aptly-named Golden State of California. Finding poker tournaments more easy to organize and more profitable than other typical fundraising schemes, such as carwashes, bake sales, and Chinese auctions, non-profit organizations in the state have followed suit in joining the poker mania that is sweeping across the United States.
However, despite the noble efforts of these churches, fire departments, and other not-for-profit groups to raise money for charitable causes, they are in fact violating California law, which states that "every person who plays ... any banking or percentage game played with cards ... for money, checks, credit, or other representative of value, and every person who plays or bets at or against any of those prohibited games, is guilty of a misdemeanor." An organizer of such events could be sentenced to a year in jail or a $5,000 fine as a penalty for violating California gaming laws.
The California Attorney General's office has made its position clear that gambling laws in the state are rigid and inflexible regarding nonprofit organizations' charitable gambling activities. The sheer popularity of poker, however, is making it highly unlikely that any particular individual or organization would be prosecuted for violating this statute.
Recognizing the altruistic nature of charity poker, as well as the widespread indifference to the state's prohibitory measures, some California lawmakers soon plan to introduce legislation that would authorize the tournament poker fundraising events of non-profit outfits to be exempt from current gambling restrictions.
